Terms

These terms apply to services provided by MBM INDUSTRIES LIMITED, Hong Kong ("ListQuay", "we"). ListQuay is a trading name of MBM INDUSTRIES LIMITED, Hong Kong.

Coverage: ListQuay supplies business contact data about individuals in the United States only, and does not supply contact data about individuals who live in, or whose listed work location is in, California, Oregon, Texas or Vermont. Leads whose location cannot be confirmed are not delivered.

Service

We provide custom B2B prospect lists built from public business data. Each lead includes a one-line personalisation note. Each delivery includes a written QA report on how emails were checked.

Pricing

Packs are one-time purchases paid through secure checkout by Stripe. There is no subscription and nothing renews.

Email-checked = the email's domain was confirmed to accept mail (MX record) within 30 days before delivery. We don't guarantee every address is deliverable; any email that hard-bounces within 30 days of delivery is replaced free on written request.

Customers must comply with CAN-SPAM and applicable anti-spam and privacy laws when contacting leads.

Bounced emails

Any email that hard-bounces within 30 days of delivery is replaced free on written request.

Bounce replacement: if an email we delivered hard-bounces (a permanent delivery failure, such as an address or domain that does not exist) within 30 days of delivery, we will replace that lead free of charge. Send a written request to support@listquay.com within those 30 days, listing the affected leads and including the bounce message for each. We will deliver replacements within 3 business days. Soft bounces (for example a full mailbox or a temporary server error), auto-replies, spam filtering and unsubscribes are not hard bounces. Replacement leads match the original brief as closely as we can and are themselves covered for 30 days. Replacement is the only remedy for bounced emails, without affecting any rights you have under applicable law.

Refunds

Leads are delivered digitally and are non-refundable once sent; any email that hard-bounces within 30 days of delivery is replaced free on written request. This does not affect any rights you have under applicable law.

Your responsibilities

You are the sender of any message you send to leads and are solely responsible for complying with all applicable laws, including CAN-SPAM, the TCPA, Hong Kong's Unsolicited Electronic Messages Ordinance (Cap. 593) and any other applicable law. Leads are for your own business-to-business outreach only. You may not resell, share or publish them, or use them for unlawful, harassing or consumer marketing. We may suspend service for misuse.

You must not use ListQuay data, in whole or in part, as a factor in deciding anyone's eligibility for credit, insurance, employment, housing or any other purpose covered by the Fair Credit Reporting Act, and ListQuay is not a consumer reporting agency.

Phone numbers. Some records include a business phone number that the listed company has published. We do not check numbers against any Do Not Call registry and do not tell you whether a number is a mobile line. You are solely responsible for complying with the Telephone Consumer Protection Act, the Telemarketing Sales Rule, national and state Do Not Call rules, and all other laws that apply to any call or text you make, including consent for automated calls or texts and calling-time limits. You must not use our data for automated or prerecorded calls or texts without the consent the law requires. If anyone asks you to stop contacting them, you must stop and tell us within 10 days so we can suppress the record. You will indemnify us for claims that arise from your calls or texts.

You must honour every opt-out, and tell us at support@listquay.com so the person is not supplied again. Delivered data is licensed to you for your own internal business-to-business outreach; you may not resell, sublicense, share, publish or combine it into a database for others.

Leads are researched and email-checked, but we do not guarantee replies or sales. To the extent permitted by law, our total liability is limited to the fees you paid in the 3 months before the claim, and we are not liable for indirect or consequential losses. Leads already delivered may continue to be used under these terms. These terms are governed by the laws of Hong Kong and the Hong Kong courts have jurisdiction, without limiting any mandatory rights you have where you live.
